Legal Counsel (Litigation)


Reporting to the Senior Legal Counsel and Deputy General Counsel, the Legal Counsel (Litigation) is responsible for conduct of the Authority’s general litigation and judicial review applications, while assisting with contentious enforcement matters including reviewing and advising on draft investigation reports for administrative fines.

 RESPONSIBILITIES:

The successful candidate will:

  • Gather relevant evidence and information in preparation for civil litigation or alternative dispute resolutions, and represents CIMA in Court hearings and other legal proceedings;
  • Manage busy caseload ensuring deadlines (including Court deadlines) are met and correspondence/documents are filed appropriately (including with the Court, external parties and internally);
  • Draft pleadings, affidavits and detailed correspondence;
  • Draft advices, prepare Court documents and support Senior Legal Counsel and Deputy General Counsel providing technically sound legal advice;
  • Seek Court Orders and civil remedies, such as the winding up of entities and disqualifications of individuals;
  • Advise on pre-action protocol matters;
  • Monitor investigations and the collection of evidence;
  • Draft requirements and directives under the Monetary Authority Act and assist with the enforcement of these where necessary;
  • Provide training to CIMA staff on legal and regulatory developments;
  • Research and draft legal opinions on legal problems and issues arising from specific contentious cases;
  • Research legal authorities and draft skeleton arguments and other submissions for Court hearings and other legal proceedings;
  • Draft internal procedures for the Legal Division;
  • Review and advise on certain correspondence regarding requests for assistance by and  to overseas regulatory authorities and negotiate new Memoranda of Understanding (MOUs);
  • Build/maintain positive, cooperative relationships with various government departments, other statutory authorities, the courts in Cayman, and overseas regulatory authorities;
  • Assist Senior Legal Counsel and Deputy General Counsel in managing outsourced litigation matters and corresponding with external counsel; and
  • Assist Senior Legal Counsel and Deputy General Counsel undertaking legal research and case analysis, as required. 

REQUIREMENTS:

  • A solicitor, barrister or attorney-at-law qualified or eligible to practice in Cayman pursuant to the provisions of the Legal Practitioners Act; and five (5) years of post-qualification experience in litigation matters;
  • Experience in financial regulation and international financial legal matters would be advantageous;
  • Experience of conducting disclosure exercises and knowledge of public law is highly desirable;
  • Experience of pre-action protocol and alternative dispute resolution is advantageous.
  • Experience of driving cases forward efficiently and effectively, delivering to a high standard, even under pressure;
  • Experience working in multi-disciplinary teams and working collaboratively with other professionals within such teams. Ability to keep an open mind and exercise sound judgement when making decisions on available information, doing so in a timely manner and being able to explain/justify them;
  • Experience of conducting interviews;
  • Experience in formulating and developing policies, processes and procedures and being able to contribute to the formation, development/implementation of the same;
  • Demonstrates an excellent knowledge and understanding of relevant legislation, regulations and procedures governing CIMA and working knowledge of the Cayman Islands Court system;
  • Ability to manage the conduct of appeals from regulatory enforcement decisions before a tribunal or court;
  • Possesses exceptional drafting skills that capture all legal complexities, displaying logical, clear and concise written arguments with attention to detail;
  • Ability to assess and analyse voluminous and data-heavy evidence, reach well-reasoned, evidence-based conclusions and defend them under challenge;
  • Excellent advocacy, research, analytical and investigatory and presentation skills;
  • Open to learning, challenge and change, being flexible and responsive to changing priorities and responsibilities and sharing know-how/ best practice;
  • Ability to advise Authority’s divisions on gathering evidence using the most appropriate powers/procedures for doing so;
  • A strong team player, effective listener, and respects and considers the views of others; and
  • Proficiency in Microsoft Office applications, especially MS Excel, Word.
